Release of the common guidelines was expected (see 2510060006).
Aimed at protecting individuals, the guidelines address gatekeepers, emphasizing how they can implement the DMA's provisions and still be in compliance with the GDPR. Additionally, data portability, data access requests and the distribution of third party apps, among other things, are addressed.
“This approach maximises usefulness of the guidance by simplifying compliance for businesses and bringing enhanced legal certainty to them,” said Anu Talus, EDPB chair.
Stakeholders may provide comments until Dec. 4. After that deadline, submissions will be available online and incorporated into the final guidelines, which will be prepared and adopted jointly by the EDPB and Commission.
In addition, EDPB noted further efforts at coordinating regulatory frameworks. For example, EDPB said the Commission's AI Office is working with it on "joint guidelines on the interplay between the AI Act and EU data protection laws."
