Plaintiff Drops BIPA Claims Against Home Depot

The plaintiff in a class-action lawsuit against Home Depot is dropping claims that the retailer violated the Illinois Biometric Information Privacy Act (BIPA), his attorneys said in a filing Thursday with the U.S. District Court for Northern Illinois (see 2508050063).

Benjamin Jankowski “is voluntarily dismissing all claims against Defendant The Home Depot ... without prejudice,” the filing said, noting no counter claims are pending. Attorneys for Jankowski didn’t comment.

The lawsuit claimed Home Depot used face-scanning technology at checkout without consumer consent (see 2508050063).
