Retail Group Appeals New York Surveillance Pricing Law

The National Retail Federation (NRF) appealed a federal court decision that allows a New York state law requiring retailers to disclose when they are using algorithmic pricing to stand. NRF made the appeal Friday to the 2nd U.S. Circuit Court of Appeals.

The U.S. District Court for Southern New York ruled on Oct. 8 in case 1:25-cv-05500 that the Algorithmic Pricing Disclosure Act doesn't impede on businesses' First Amendment rights and allowed it to stand (see 2510090015).

The NRF filed its lawsuit on July 2, arguing the statute interferes with the role of retailers and is government-compelled speech (see 2507070042).
