33 States, D.C. Support Arkansas Social Media Law

Florida and a bipartisan coalition of 32 states and the District of Columbia supported an Arkansas social media law in an amicus brief Wednesday. They claimed a “district court erred in permanently enjoining … the Social Media Safety Act” (see 2504010044).

Arkansas has “a compelling interest” in keeping kids safe online, while NetChoice hasn't established that the Act is unconstitutional, the coalition said: Nor does the tech association have standing to sue.

The U.S. District Court for Western Arkansas said in March that the age-verification law violated the First and 14th Amendments, ruling for tech trade association NetChoice in case 5:23-cv-05105. But a month later, Arkansas Gov. Sarah Huckabee Sanders (R) signed amendments to the law (see 2504250042).

Though Judge Timothy Brooks from the district court declined to amend his previous ruling in July (see 2507240036), Attorney General Tim Griffin (R) asked the 8th U.S. Circuit Court of Appeals to toss his ruling (see 2507310064).

The AG additionally argued in August that since Arkansas has amended the law being challenged in court, case 25-1889 should be dismissed (see 2508190054).
