Federal Judge Allows ICE to Use Medicaid Data in Deportation Cases

Immigration and Customs Enforcement (ICE) can use Medicaid data in deportation cases, a federal judge ruled Monday in a victory for the Trump administration (see 2507010060 and 2508130031).

California Attorney General Rob Bonta and 21 other Democratic AGs sued in July to block the practice. The U.S. District Court for Northern California on Monday issued an order granting in part and denying in part the AGs’ motion for preliminary injunction.

“The sharing of such information is clearly authorized by law and the agencies have adequately explained their decisions,” U.S. District Judge Vince Chhabria wrote in his 7-page ruling in case 25-cv-05536-VC, citing compliance with the Administrative Procedure Act. The motion is “granted to the extent the new policies authorize the sharing of information beyond these categories because the new policies are totally unclear about what that information would be, why it would be needed for immigration enforcement purposes, and what the risks of sharing it with DHS would be.”
